SAN FRANCISCO—The U.S. International Trade Commission (ITC) said last month it would investigate two complaints made by Elpida Memory Inc. and and Nanya Technology Corp. against one another.
The ITC said it would investigate Nanya and its U.S. subsidiary based on a complaint filed by Elpida and its U.S. subsidiary on Nov. 15, 2011. That complaint alleges violations of section 337 of the Tariff Act of 1930 in the importation into the U.S. and sale of certain semiconductor chips with DRAM circuitry and modules and products containing same that infringe patents asserted by the complainants. Elipda requested that the ITC issue an exclusion order and cease and desist orders barring the importation of the Nanya chips, the ITC said.
Also last month, the ITC announced it would also investigate a complaint filed by Nanya against Elpida, Elpida's U.S. subsidiary and Kingston Technology Co. That investigation is based on a complaint filed by Nanya on Nov. 21, which also alleges violations of section 337 of the Tariff Act of 1930 in the importation of Elpida DRAM parts that infringe patents asserted by Nanya. It also requests that the ITC issue exclusion orders and cease and desist orders.
As is typical, the ITC said it expects to make final determination in both investigations at the earliest practicable time and that it would set target dates for completion within 45 days of each investigation's launch.
